Thakur said that when Jio was rolled out, there were 22,000 tariff plans and compared to that, Jio has 7-10 price plans for all subscribers.

TDSAT in an interim ruling on Tuesday, also barred the watchdog from imposing any penalty on telcos for violating the new rules on reporting tariff plans, including offers to select subscribers, until further orders.

It said the changed definition of significant market power with regard to predatory pricing and the order to report all discounts or concessions offered in tariff plans to retain customers have “significant impact and ramifications.”

Trai’s tariff order on February 16 changed the definition of SMP to identify predatory pricing, a strategy aimed at driving competitors out of the market or creating entry barriers for potential new competitors. The new SMP gave pricing flexibility only to operators with less than 30% of the market’s subscribers or revenue and dropped previous parameters such as volume of traffic including data and switching capacity.

Bharti Airtel and Idea Cellular moved the tribunal against the Trai tariff order on March 4.
